Parties, scope, and acceptance
Conectados eSIM operates commercially as Conectados eSIM from Mexico and offers the Distributor Program through conectadosesim.com. These terms form the commercial agreement between Conectados eSIM and the applicant or approved distributor.
Questions and notices may be sent to soporte@conectadosesim.com. Checking the acceptance box and submitting the application means you read and agree to this version and acknowledge the Privacy Notice.
Eligibility, application, and approval
You must be at least 18 years old and legally able to enter into a contract. If you act for a company, you represent that you have sufficient authority to bind it. Registration information must be complete, current, and accurate.
An application does not guarantee admission. Conectados eSIM may validate it, request clarification, and approve, reject, or keep it under review using reasonable operational, security, compliance, and commercial criteria.
Independent commercial relationship
The distributor participates on its own account as an independent merchant. These terms do not create employment, mandate, agency, partnership, franchise, legal representation, exclusivity, or authority to bind Conectados eSIM before third parties.
The distributor determines its organization, schedule, customers, and sales methods, bears its own expenses and commercial risks, and remains responsible for tax, labor, administrative, and social-security obligations. The actual nature of the relationship prevails whenever mandatory law provides otherwise.
Account, security, and registration details
The account is personal to its holder and may not be sold, assigned, shared, or made available to third parties. The distributor must protect passwords, private links, QR codes, and sessions, and immediately report any unauthorized access or transaction.
Changes to country, holder, legal name, tax details, or payout method may be reviewed before taking effect. Conectados eSIM may temporarily block a transaction when there are reasonable signs of fraud, impersonation, or account risk.
Purchase balance
Purchase balance is a prepaid ledger in Mexican pesos that may only be used to acquire eSIMs in the portal. It is not a bank account, deposit, investment, regulated e-wallet, or general payment instrument and does not earn interest.
When balance is insufficient, Stripe may charge the permitted shortfall and any difference caused by the processor minimum may remain as available balance. Except where required by law, needed to correct a charge, or expressly authorized, purchase balance is not redeemable for cash and is not paid as commission.
eSIM purchase, issuance, and delivery
Each order is subject to availability, coverage, device compatibility, and confirmation by the connectivity provider. A charge or balance reservation alone does not guarantee issuance until the order is delivered.
The distributor must review destination, validity, data allowance, and compatibility before confirming. Profiles, QR codes, and private links must be delivered only to the relevant customer and may not be published, duplicated, or reused.
Duties toward end customers
The distributor must provide clear, verifiable, and non-misleading information about total price, destination, data, validity, activation, compatibility, coverage, restrictions, support, and cancellation rules. It may not promise speed, coverage, refunds, or features not shown in the portal.
Before a sale, the distributor must make the applicable purchase terms, privacy notice, and refund policy available to the customer. It must retain sufficient transaction evidence and directly honor commitments it makes to its customer without attributing unauthorized promises to Conectados eSIM.
Commissions, tiers, and promotions
Commission is calculated on the recorded price of each successfully delivered eSIM using the current tier based on eSIMs sold. The normal percentage will never exceed 20%. During a system-identified sitewide promotion, the applicable commission will never exceed 15%, even if the tier shows a higher percentage.
Commissions first remain pending for the hold period displayed in the portal and then become available. Tiers, caps, and hold periods may change prospectively; a change will not reduce accrued commissions except to correct an error, refund, chargeback, fraud, duplicate, or cancellation tied to the sale.
Payouts and payout method
Only available commissions may be withdrawn and the request must meet the portal minimum. Persons registered in Mexico must provide a valid CLABE held by them or the entity they represent; persons registered outside Mexico must provide a PayPal account able to receive the payment.
The distributor is responsible for destination accuracy and ownership. Timing depends on review, the bank, PayPal, non-business days, and fraud controls. Receiving, currency-conversion, or provider fees may be deducted when disclosed or directly charged by the payout provider.
Cancellations, chargebacks, and adjustments
A refunded, canceled, duplicated, fraudulent, or cardholder-disputed sale may cause a proportional reversal of the related commission. If already paid out, the adjustment may be offset against future commissions; before requesting direct repayment, Conectados eSIM will provide an itemized explanation and a way to dispute it.
Conectados eSIM will not arbitrarily withhold undisputed amounts. When a review affects a payout, its status will be shown and the distributor may provide supporting documents through support.
Taxes and documentation
Each party is responsible for determining, reporting, and paying its legally applicable taxes. The distributor must provide tax ID, tax residence, invoices, or supporting documents when needed to pay commissions or comply with withholding and reporting duties.
Displayed amounts are not tax advice. Conectados eSIM may make legally required withholdings and provide the corresponding record when applicable.
Brand, advertising, and prohibited practices
While the account is active, the distributor receives a limited, revocable, non-exclusive, non-transferable permission to use brand materials expressly supplied to promote the eSIMs. It may not register confusing domains, profiles, ads, or signs; alter logos; claim to be a branch or mobile operator; or make statements on behalf of Conectados eSIM.
- Spam, misleading advertising, impersonation, fraud, or sales to minors without required authorization.
- Order manipulation, fictitious self-referrals, duplicate accounts, or evasion of tiers, caps, promotions, or controls.
- Reselling account access, publicly disclosing QR codes, or using the service for illegal or abusive activity.
Personal data and confidentiality
The Privacy Notice explains how registration, operation, payment, and support data are handled. Financial or asset information provided for payouts is used only for validation, payment processing, security, accounting, and compliance under the express consent collected when it is saved.
Each party must protect confidential information and personal data it receives. The distributor may process customer data only under a valid legal basis, for disclosed purposes, and with reasonable security measures, and must not upload data the portal does not request.
Suspension and termination
Conectados eSIM may suspend purchases or payouts while investigating fraud, breach, security risk, chargebacks, false information, or an authority request. When reasonably possible, it will state the reason and provide an opportunity to clarify it.
Either party may end participation. Termination does not cancel paid orders, tax duties, confidentiality, intellectual property, adjustments, or the right to receive validly accrued and undisputed commissions. Amounts under investigation may remain reserved until the review is resolved.
Availability, support, and liability
The portal and services depend on networks, operators, eSIM Access, Stripe, PayPal, banks, and third-party infrastructure. Maintenance, coverage changes, and interruptions outside the parties’ reasonable control may occur. Conectados eSIM provides operational support but does not guarantee uninterrupted availability or speed.
Each party is responsible for direct loss caused by its proven breach. To the fullest extent permitted by law, neither party is liable for lost profits or unforeseeable indirect loss. This limitation does not apply to fraud, willful misconduct, payment duties, confidentiality, personal-data or intellectual-property violations, or liability that cannot legally be limited.
Changes to these terms
Material changes will be published with a new version and effective date. If they materially affect commissions, payouts, or duties, new acceptance will be requested before continued use of affected functions. Urgent changes required by law, security, or a provider may apply from their mandatory date without affecting vested rights.
Governing law, disputes, and electronic records
These terms are governed by the laws of Mexico. Before going to court, the parties will try in good faith to resolve any dispute through support for at least 30 calendar days. If unresolved, the authorities and courts with jurisdiction under applicable law may hear the dispute, without limiting any forum granted by mandatory law.
Acceptance through the checkbox, together with the account, version, date, and technical request records, is electronic evidence of consent. Data messages and records will be retained for applicable legal and operational periods. If one clause is invalid, the remaining clauses continue in effect.
